Milnerton High learners accused of assault granted bail

A group of Milnerton High School learners, accused of assault with intent to cause grievous bodily harm, have been granted bail of R2000 each in the Cape Town Magistrate’s Court.

 

Six of the learners are over 18 and appeared in the adult section of the Court on Thursday, while the two other accused appeared as minors in the children’s section.

 

The NPA has confirmed that one of the minor learners has been released on a warning, while the second minor accused will be assessed on Friday, but he has also been released in the care of his family.

 

The state did not oppose bail for the six adult accused, as all are first-time offenders, and they have fixed addresses. The court also heard that eight complainants have come forward to lay charges, all between the ages of 15 and 16 years old.

 

The State Prosecutor told the court that more charges could be added, as investigations continue.

 

He said that according to the State’s information, the accused’s precautionary suspension is set to be lifted next Thursday, so they can be allowed to write exams.

 

The Magistrate then expressed concern about the accused returning to the school to write their exams, as this may lead to further victimisation of the complainants.

 

She requested that a different venue be found for the accused to write their exams. The Western Cape Education Department agreed to provide an alternative venue.

 

In terms of the bail conditions, the Magistrate ruled that the accused cannot make contact with the complainants, and not to get closer than 80 metres to the complainants.

 

They were also required to hand over their cellphones and PINs to investigators. They may not enter the school premises until the matter is finalised.

 

The court has prohibited the media from publishing any pictures or names of the accused or complainants.

 

The matter has been postponed until 20 January 2026 for further investigation.

 

The State has appealed to the public to allow the law to take its course and not to interfere with the investigations.
