The trial on the murder of five-year-old Xavier Mitchell, who was stabbed to death in Bishop Lavis more than a year ago, is set to begin next month.
The case will finally proceed after the local Magistrates Court on Thursday declared the accused, Mervyn White, fit to stand trial.
White underwent psychiatric evaluations following the August 2024 incident, after reports suggested he was mentally challenged at the time of his arrest.

The Bishop Lavis Crime Prevention Forum (BLCPF) welcomed the latest developments, with its chairperson, Graham Lindhorst, saying that it brings Xavier’s family closer to justice.
“As family and the community we now put our trust in the investigation team to present a watertight case and give the answers to the many questions the mother, father and the community has,” said Lindhorst.
Lindhorst further appealed to the community to support Xavier’s grieving family during this next phase of the court process.
“All we want to know is why he killed Xavier. We further call on the community to continue supporting the family on this traumatic journey they were plunged in.”
Little Xavier was attacked in Sky Road on 7 August, after which he was transported to a local hospital. Police confirmed that he had three stab wounds in his back and was subsequently declared dead.
Western Cape police spokesperson, Captain Frederick Van Wyk, confirmed at the time that “a male in his forties, believed to be mentally challenged, was arrested and detained by the Bishop Lavis police immediately after the incident”.
Lindhorst confirmed that the trial will take place at the Parow Regional Court, with White’s first appearance in this regard scheduled for 10 November.
