The Constitutional Court has set aside an order of the Gauteng High Court in Pretoria, which declared a section of the Riotous Act unconstitutional and invalid. The EFF challenged the Act on the basis that it was apartheid legislation. The Court handed down judgment in a complex legal matter which will have important bearing on the National Prosecuting Authority’s prosecution of EFF leader Julius Malema for allegedly inciting people to occupy land.
