Live Inside & Win The Ride – Rules & Regulations

  1. ELIGIBILITY
    • Each entrant must be a legal resident of the Republic of South Africa and must be at least 18 (eighteen) years old.
    • Each of the entrants consent to being photographed for print, TV and any other media.
    • Each finalist consents to being profiled on all Smile 90.4 FM channels: including but not limited to website, social media and public relations.
    • Each finalist gives Smile 90.4 FM access to his or her personal details for the marketing of this campaign.
  1. MEDICAL
    • Each finalist will undergo a psychological and medical examination before the competition starts, at a time to be arranged by Smile 90.4 FM
    • Each finalist will produce a letter from their doctor/s confirming that they are physically fit to compete in the above competition, by no later than noon, 7 (seven) days before the start of the competition.
  1. THE VEHICLE
    • Prizes may not be exchanged for cash or any other prize, nor are they transferable.
    • The keys to the Vehicle will not be kept inside the Vehicle.
    • Any additional expenses over and above the prize (the Vehicle) will be for the winner’s own account.
    • The winning vehicle is identical to the one used in the competition.

    • Insurance of the vehicle will be for the winner’s account
  1. LIVING IN THE CAR
    • The last remaining entrant in the vehicle will be the winner of the Live Inside and Win the Ride competition, and the decision of Smile 90.4FM will be final.
    • Should an entrant leave the vehicle at any time (other than during the allocated break times) and for any reason whatsoever (including medical), they will be immediately disqualified and required to sign an exit contract.
    • Each Finalist will receive a 20 (twenty) minute break (to do as they please, brush teeth, freshen up etc.) once every 3 (three) hours. The 20 (twenty) minute breaks will be for the first 20 (twenty) immediately after the lapsing of every 3-hour period. This will be timed by the security on duty. Failure to return at the stipulated time will result in immediate disqualification.
    • The twenty-minute time limit will be strictly adhered to – even a second late will result in immediate disqualification.
    • The time of the breaks may change at any time during the promotion.
    • The seating position for the 5 (five) entrants will be done by way of lucky draw (driver, passenger, middle rear, left rear and right rear).
    • The entrants will not be allowed to use their cell phones or any electronic devices such as iPads, tablets or laptops; or have a cell phone or any electronic device on their person during the competition unless instructed to by Smile 90.4FM.
    • The entrants will not be allowed to recline the seats in the vehicle or adjust the seats in any way.
    • No pillows or blankets or other comfort device are allowed in the vehicle.
    • No form of racism or abuse or sexual harassment will be tolerated, and any implication of this behaviour will lead to immediate disqualification.
    • The entrants will not open the doors of the vehicle, even during dedicated break times.
    • The entrants will be allowed to open the Vehicle’s windows.
    • Security and cameras will monitor the entrants 24 hours a day. There will also be a video camera inside the Vehicle monitoring activity within the car and static webcams around the car to monitor the entrants at all times. This will be live-streamed.
    • There will also be a live microphone in the car to monitor and broadcast the conversation in the car.
    • The security guards will collect all rubbish and litter only.
    • The entrants are allowed to have contact with family, friends or visitors whilst inside the Vehicle, for the duration of the competition.
    • No visitors may cross the stanchion divider.
    • There shall be no physical interaction with the public whilst inside the car.
    • In the event of a dispute in regard to any aspect of the competition and/or these terms and conditions, the decision of Smile 90.4 FM Programming Manager or his appointee will be final and binding and no correspondence may be entered into.
    • In the event of an emergency, the entrant will be directed by security and the competition will be suspended until further notice by the management of Smile 90.4 FM
    • As soon as an entrant leaves the Vehicle, and is therefore disqualified, they are to report to Smile 90.4FM for an interview.
    • The Entrants will not be allowed to give statements to the media without obtaining written permission from the Managing Director of Smile 90.4FM
  1. PROVISIONS FROM CAPE TOWN RADIO T/A SMILE 90.4 FM
    • Meals will be supplied by vendor as approved by Smile 90.4FM
    • Smile 90.4 FM will provide security personnel for the duration of the competition.
    • The security personnel will be continually in touch with the team at Smile 90.4 FM and may have proxy authority to instruct the entrants.
    • Should the law or any authority terminate this competition, no notice of termination shall be required. In such event, all the Entrants waive any rights and acknowledge that they shall have no claim, of any nature whatsoever against Cape Town Radio (PTY) Ltd T/A Smile 90.4 FM directors, agents or employees as a result of the termination.
    • Smile 90.4FM reserves the right to vary, postpone, suspend or cancel the competition and any prizes that have not yet been won, or any aspect thereof, without notice at any time and for any reason whatsoever that Smile 90.4FM deems is reasonable at the time.
  1. ACCEPTANCE AND SIGNING
    • Should a Finalist breach any of the above rules, that Finalist will be disqualified from the competition
